1. Acceptance of the General Terms and Conditions of Sale

The present General Terms and Conditions of Sale govern the contractual relations between the customers and the website www.lowcko.com published by the company Shama Low LTD.

The validation of an order on the part of a customer implies the acceptance of the entirety of the present General Terms and Conditions of Sale.

Lowcko grants itself the right to suspend or cancel the account of a user who is malicious or who does not comply with these General Terms and Conditions of Use.

 

 

2. Products and spare parts

Our product offers on www.lowcko.com are valid only during their online presence.Any unavailability of products does not entitle the customer to damages.

 

3. Public price

All prices displayed on www.lowcko.com are in Euros. Shipping costs (if applicable) are not included in the price indicated on the product sheet.

The total amount indicated in the summary of your order is the final price. This amount includes the price of the total order with the details of each product.

The prices are all indicated inclusive of all taxes including VAT.

The products remain the property of Lowcko.com until full payment has been received.

 

4. Order

Lowcko.com first confirms to the customer the acceptance of the order by e-mail to the address registered by the customer. In the case of payment by credit card, the sale is only considered to be concluded once the payment has been accepted by our payment system.

Our company reserves the right to refuse or cancel any new order coming from a customer with whom a dispute exists or for other reasons (suspicion of fraud, out of stock, etc.).

Orders are processed from Monday to Friday. When an order is placed, the customer provides the following information under his sole responsibility:

In the event of an error in the wording of the recipient's details, Lowcko.com cannot be held responsible for the inability to deliver. In this case, the order will be returned to our warehouses and we will refund the order within a maximum of 30 days after the date of return.

The purchase invoices can be consulted and printed on the customer account.

5. Shipping

We use the most suitable shipping method for each package.  We dispatch your orders within 24h/48h.

 

6. Delivery

Deliveries are made by La Poste, Colissimo, TNT, DPD, GLS or selected specialised carriers. Delivery costs (if applicable) are partially charged to the customer, they include handling and packing costs. The participation in the shipping costs if applicable is recalled and detailed before each order validation.

Delivery times:

The average delivery time is 1 to 3 working days from the date of dispatch (3 to 4 days for Corsica) by colissimo and courier. This delivery time is not contractual. No damages are due in the event of any delay in delivery.

Delivery by the royal post :

It is the responsibility of the customer to check the good condition of the parcel on receipt. If the packaging is damaged, the package should be refused by the delivery person.

If the customer finds that an item is broken, he must contact the local post office in order to establish a spoliation report within a maximum of 48 hours.

The customer must quickly send his complaint by e-mail so that it can be dealt with by our After-Sales Service.

In case of absence :

A calling card will be left in the letterbox so that the customer can collect his parcel from the nearest post office.

Delivery by Carrier :

It is the customer's responsibility to check the good condition of the parcel on receipt. In the event of a missing or damaged package, the customer must make specific reservations on the carrier's delivery slip, a registered letter within 48 hours must be sent to the carrier and a copy sent to our company.

The customer must quickly send his complaint by e-mail so that it can be processed by our After-Sales Service.

In case of absence :

Our company cannot be held responsible for the consequences due to a delay in delivery.

 

7. Payment

It can be carried out 

- by credit card in one go: Visa, MasterCard, EuroCard.

-by credit card in several times if applicable.

- by Paypal if applicable.

- by bank transfer in certain cases of large orders (over 1500 euros and by contacting us.) In this case, the order will be pending and validated only upon receipt of your payment. A RIB will then be sent to you for payment.

At the end of your order, select the payment method that suits you.

Lowcko.com uses the secure online payment system in order to guarantee maximum security for its customers. The personal information that customers are led to communicate is perfectly secure, protected and encrypted before transmission to the processing centre. We have absolutely no access to your bank details, they are 100% managed by our service provider.

To protect you and prevent fraud, all payments on our site are subject to the Smart 3D security system developed by our partner.

A customer's order will only be considered effective once the payment centre has given its agreement and lowcko.com has validated it after control. In the event of refusal on the part of our payment tool, the order will be automatically cancelled. In the event of suspicion of fraud, or for any internal reason (stock out, customer dispute, etc.) we reserve the right to cancel the order and our company will notify the customer concerned by e-mail, and will then proceed to refund the order immediately and without delay.

Please note that

We reserve the right to suspend or cancel any order, whatever its nature and level of execution, in case of non-payment of any sum

due by the buyer, payment incident, suspicion of fraud, stock error, or for any internal reason within our company.

In the event of non-payment of an invoice within the agreed period, the buyer will owe Lowcko.com, in addition to the principal amount, by right and without prior notice of default, default interest at the rate of 1.5% per month, as well as a fixed compensation of a total amount of 15% of the principal amount of the order excluding VAT, interest and costs, with a minimum amount of € 50.

In the event of legal recovery, the buyer shall also be liable for the costs of recovery, such as legal costs and internal management costs, which exceed the amount of this fixed compensation.

In the event that the customer fails to meet a single payment deadline, for whatever reason, Lowcko.com reserves the right to suspend the execution of all other orders in progress until full settlement of the amounts due. Lowcko.com reserves the right to request proof of address and a photocopy of the purchaser's identity card for purchases over 249 Euros or in the case of a proven suspicion of fraud detected by our payment system.

 

8. Satisfied or Reimbursed and retraction

 

The customer has a legal period of 14 clear days from receipt of his order (article L 121-16 of the Consumer Code) to return an item that does not suit him.

Lowcko.com undertakes to exchange or reimburse (according to banking constraints) the article provided that it is returned intact in its original packaging, without any trace of use and accompanied by the purchase invoice. Items returned incomplete, damaged or soiled by the customer will not be taken back, exchanged or refunded.

The return costs are at the customer's expense.

9. Product quality and guarantees

All our products benefit from the manufacturer's or manufacturer's guarantee for a period of 2 years. This guarantee covers removal, parts and labour.

Our company, in accordance with the provisions of the legal guarantees of conformity and hidden defects, undertakes, at the customer's choice, to reimburse or exchange the product concerned. Should an item be defective or non-compliant, the customer must contact our company. After having informed us of the intention to return the item and having obtained an agreement, a return slip will be sent to you and the item must be in its original packaging and accompanied by its purchase invoice. Lowcko organises and ensures the return of the product through our approved carriers.

It is reminded that within the framework of the legal guarantee of conformity, the Customer :

Benefits from a period of two (2) years from the delivery of the good to act towards the seller;

He can choose between repairing or replacing the goods, subject to the cost conditions provided for in article L. 211-9 of the French Consumer Code;

He is exempt from having to provide proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods. This period is extended to 24 months from 18 March 2016.

 

10. Litigation

The client and our company will always favour an amicable solution before any legal action. The customer can contact our customer service by email: contact@lowcko.com. Your satisfaction is very important to us, therefore we will always do our utmost to provide you with the best possible solution.

RESERVE OF OWNERSHIP: We reserve the ownership of the goods until payment of the price by the buyer. Our right of claim relates both to the goods and to their price if they have already been resold (Law of 12 March 1980).

In the event of a dispute, you can contact the company Lowcko.com directly by e-mail, chat, telephone or post.

 

If the dispute is not settled amicably, in application of article L.141-5 of the French Consumer Code, the consumer may refer the matter to the company at his or her discretion:

-A mediator.
